Expert Witness Services

Acuitas professionals have testified numerous times in State Courts, Federal Courts, Delaware Chancellery Court as well at mediations and arbitrations.  We are very experienced in taking complicated financial issues and breaking them down into easy to comprehend concepts that can be understood by the trier of fact whether that be a Judge or a Jury.  Our area of expertise includes, but is not limited to:

  • Accounting Malpractice. We have been retained by counsel representing both plaintiffs and defendants in accounting malpractice cases.   Our experiences include evaluating allegations of improper audits, alleged provision of improper tax advice, alleged deficient due diligence services, or other types of consulting engagements.  Our professionals are well versed in the professional standards issued by the American Institute of Certified Public Accountants, Generally Accepted Accounting Standards, and Generally Accepted Auditing Standards.
  • We are often retained to calculate damages on behalf of plaintiffs involved in commercial disputes and to provide expert testimony at trial or in other dispute resolution settings. We are experts in the generally accepted methods for calculating damages while following the rules established by case law as well as the professional standards governing the provision of such services.  The types of cases we are most often retained in include alleged breach of contract, business interruption cases and situations involving civil and criminal torts.

We are also retained by defendants to review and if necessary, rebut, claims of damages put-forth by plaintiffs in similar cases.  We work with counsel to identify improper damages methodologies; assumptions made without sufficient background and often produce “rebuttal” reports and testify at trial as to why the plaintiff’s expert’s calculations may be faulty and not in compliance with case law or professional standards.
